The planning activities of units of local self-government are not new in the field of law, and yet it constitutes one of their more important management aspects. It is extremely important in particular in the processes of heritage management at the self-government level, because when implementing monument conservation programmes the units of local self-government supplement state measures in the field of monument protection. In the commented judgment, not only did the Supreme Administrative Court confirm the rank and significance of monument conservation programmes, but also stated that a municipal council cannot revoke an applicable monument conservation programme without simultaneously adopting a new one. Thus the Supreme Administrative Court identified the obligation to ensure continuity of heritage management programmes at self-government level. In her approving commentary, the author – while adopting a holistic approach to monument protection – presents the importance of monument conservation programmes on the basis of principles of cultural heritage protection law, which are the latest achievement of heritage protection law studies.
