This article analyzed universal and regional instruments for the protection of the right to education of refugees. The right to education is positive, and it is a state responsibility to make education available, accessible, acceptable and adaptable. Accessibility of the education, inter alia, means that “educational institutions and programmes have to be accessible to all, especially the most vulnerable groups”, which are, inter alia, refugees. In this article also differentiated are the obstacles to exercise the right to education of refugees, such as languages difficulties, absence of documents, lack of qualified teachers, absence of classrooms, child labor, young marriages, unwillingness of parents to educate their children, etc. and the solutions on how to improve the practical realization of the right to education of refugees are proposed
